Rental Agreement
This Rental Agreement and Waiver of Liability (“Agreement”) is entered into between Mountain Time Rentals (“Company”) and the undersigned customer (“Renter”). By proceeding with your rental, you agree to be bound by the terms below.
1. Rental Items
The Company agrees to rent to the Renter the rental property associated with the Renter’s reservation, as defined by the Company’s booking system and records at the time of rental (the “Rented Property”).
2. Responsibility for Damage, Loss, or Theft
Renter is responsible for the Rented Property during the rental period, including any damage, loss, or theft that occurs while in their possession, except as limited below.
Renter shall not be responsible for:
- Damage caused by normal wear and tear
- Pre-existing mechanical defects not resulting from misuse or negligence by the Renter
In the event of damage, loss, or theft:
- Renter agrees to pay the full replacement cost, defined as the current retail or insured replacement value, or the actual cost of repairs as determined by an authorized repair center, whichever applies.
- Renter authorizes the Company to charge the provided credit card for such costs.
- In the case of theft, a police report must be filed immediately and provided to the Company.
3. Credit Card Authorization
Renter agrees to provide a valid credit card prior to taking possession of the Rented Property. Renter hereby authorizes Mountain Time Rentals to charge the card for:
- Rental fees
- Damage or replacement costs
- Late return fees
- Cleaning fees (if applicable)
A pre-authorization or security hold may be held on the card at the Company’s discretion.
The Company shall notify the Renter in writing of any charges exceeding the rental fees before processing the payment.
4. Return Conditions
Renter agrees to return the Rented Property:
- By the agreed-upon return date/time
- In clean and working condition
Failure to do so may result in:
- Late fees of base rental fee per day
- Cleaning fees if the equipment requires more than standard cleaning procedures (e.g., mud, grease, or biological waste)
- If the Rented Property is not returned and no communication has been received within 48 hours, the Company reserves the right to report the equipment as missing or stolen to local authorities.
5. Prohibited Use
Renter agrees not to:
- Use the equipment or vehicle for unlawful purposes
- Operate vehicles under the influence of drugs or alcohol
- Allow unlicensed or unauthorized individuals to use the equipment or vehicles
- Alter, modify, or tamper with the Rented Property
- Sublease, transfer, or remove the Rented Property from the Province of Alberta without written consent from the Company
6. Indemnification
Renter agrees to indemnify and hold harmless Mountain Time Rentals, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, or expenses (including legal fees) arising out of the Renter’s use, misuse, or failure to return the Rented Property, except to the extent caused by the Company’s own negligence or willful misconduct.
7. Assumption of Risk & Liability Waiver
Renter acknowledges and agrees that use of the Rented Property involves inherent risks that may result in personal injury, property damage, or death.
By signing this Agreement, Renter voluntarily assumes all risks associated with the use of the Rented Property.
Renter hereby releases, waives, discharges, and covenants not to sue Mountain Time Rentals, its owners, employees, contractors, or affiliates for any liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained while using the Rented Property, except for losses caused by the gross negligence or intentional misconduct of the Company.
8. Inspection and Acceptance
Renter acknowledges they have inspected the Rented Property prior to use and found it in good working condition. Any pre-existing damages must be documented and acknowledged by both parties prior to rental.
The Company warrants that the Rented Property is in good working order and has been maintained in accordance with manufacturer recommendations at the time of rental.
9. Cancellation Policy
Cancellations made more than 2 days prior to the rental start date will receive a full refund.
Cancellations within 1 day may incur a 10% cancellation fee.
No-shows or cancellations after the rental start time are non-refundable.
Refunds for early returns or weather-related interruptions are at the Company’s discretion.
10. Insurance
The Renter is responsible for verifying whether their own insurance or credit card coverage applies to rental equipment.
The Company’s insurance, if applicable, may not cover third-party liability or renter negligence unless otherwise stated in writing.
11. Limitation of Liability
To the fullest extent permitted by law, the Company’s total liability for any claim arising from or related to this Agreement shall not exceed the total rental fees paid by the Renter.
The Company shall not be liable for any consequential, incidental, or indirect damages.
12. Force Majeure
Neither party shall be liable for failure or delay in performance due to circumstances beyond their reasonable control, including natural disasters, government restrictions, or other acts of God.
13. Governing Law & Venue
This Agreement shall be governed by the laws of the Province of Alberta, and any disputes shall be resolved in the courts located in Calgary, Alberta.
By proceeding with your rental, you acknowledge that you have read, understood, and agree to be bound by this Rental Agreement & Liability Waiver.
